All foreign enterprises in Ghana are required to register with Ghana Investment Promotion Centre (“GIPC”), whilst wholly owned Ghanaian enterprises may also register with GIPC. These enterprises are required by law to register their technology transfer agreement (“TTA”) with the Centre to enable GIPC monitor the technologies that these enterprises bring to Ghana.
To further improve enforcement of the laws on TTA, GIPC works with other Government institutions. The Bank of Ghana (“BoG”) uses its regulatory powers to stop all funds transfers for TTA services which have not been registered. Enforcement measures are being enhanced, including increased monitoring and stricter penalties for non-compliance, to ensure adherence to the regulations.
Registration, therefore, brings TTAs under the monitoring of GIPC and allows enterprises to transfer funds to pay for the technology services in a lawful manner.
The GIPC Act and TTA L.I. regulates the provisions or content of TTAs, making it a regulated agreement, and its preparation could take a lot of the productive time of companies.
